Death sentence for Joe Ferrari reduced to life in prison

THE Central Criminal Court for Corruption and Misconduct Cases this morning (June 8) sentenced Pol. Col. Thitisan Uttanaphon, aka Superintendent Joe Ferrari, and six of seven of his subordinates to death for intentionally torturing a drug suspect to death with two plastic bags but this was commuted to life imprisonment because of mitigating circumstances, Sanook.com said

The judge of the Court of First Instance handed down the verdict via video conference system to the defendants and their families at the prison where they are detained.

The former superintendent Muang Nakhon Sawan police station was found guilty on all four counts, that is  malfeasance, abuse of authority,  intentionally torturing leading to death and coercion, in the death by suffocation of the suspect Mr. Jirapong Thanapat, or  Mawin, 24

However Superintendent Joe’s death sentence was commuted to life imprisonment because he did try to save the victim’s life by rushing him to the hospital.

The court also ruled defendents 1-5 and 7 too were guilty as charged and sentenced them to death for the brutal murder of the suspect but this was reduced by one third to life imprisonment.

The sixth defendant was found guilty of malfeasance and was sentenced to 5 years and 4 months according to  Criminal Code, Section 157.

Pol. Col. Anek Taosupap, deputy commander of the Crime Suppression Division, had said that the full autopsy report from Sawan Pracharak Hospital stated that the drug suspect died from asphyxiation, or suffocation. While drug use did show up, this was not the cause of death.
