REGION 8 Appeals Court today (May 23) overturned the lower court’s verdict dismissing a case against a Swiss man on charges of having kicked a Thai woman doctor as she sat on the stairs leading from his villa to Phuket’s Cape Yamu beach in February last year and sentenced him to one month in jail without suspension, TV Channel 7 said.
Mr. Nipit Intarasombat, a former politician and a lawyer, fought this case against Mr. Urs Fehr, or David, 46, on behalf of Dr. Pai.
He said the Swiss man had been found guilty under Section 391 of the Criminal Code, which is considered a serious offence, and sentenced to one month in prison without suspension.
He thanked all parties, including police investigators, prosecutors, the courts, the previous lawyer and the defendant’s lawyer for having carried out their duties to the fullest.
“We are not enemies, we just have different opinions on facts and the law,” he said.
Nipit added that he accepted this case at the appeal stage without asking for any payment including travel expenses and airfares because he understood the feelings of the doctor and the people of Phuket as well as all Thai people.
However the defendant has likely fled the country, he mentioned.
